Having a Forensic CPA can reveal essential information during the Divorce process. Our work in Complex Dissolutions of Marriage has included: (a) establishment of the lifestyle and financial needs of one or the other spouse, (b) establishment of the ability of a spouse to pay those needs, (c) establishment of the martial and non-marital assets and liabilities of the marital estate available for Equitable Distribution, including the valuation of any business in which either party, directly or indirectly, owns or owns an interest, and (d) whether deferred compensation is an asset available for equitable distribution or income for alimony and/or child support, and (e) uncovering undisclosed assets.
It is no surprise that financial issues are among the most contentious in divorce actions. The financial aspects associated with marital disputes and dissolution are often complex and consume most of the effort and attention of the parties. Forensic Accountants (most often CPAs) possess unique skills that allow them to provide valuable support to divorcing spouses and their attorneys. While attorneys have traditionally engaged accountants to assist with general financial issues related to divorce, attorneys are increasingly relying upon forensic accountants to provide more in-depth forensic services beyond alimony and child support calculations. The stakes are rising in today's volatile economic climate and employing the expertise of a qualified forensic accountant can make a considerable difference in the outcome for you or for your client.
Damage claims for lost profits are fact and circumstance intensive. The expert's opinion of lost profits is subject to interpretation by a finder of fact, based on the evidence, the methods applied by the expert and the components of the lost profit calculations. The need for credible financial experts has never been greater than it is today. The need for a lost profits calculation begins with the plaintiff's allegation(s) contained within the complaint. Most financial experts approach the calculation(s) from two perspectives: (a) calculation of incremental lost revenues and related avoided costs, or (b) the difference between the net profits that the company would have attained, but for the damaging event, and the net profits actually obtained. Both of these methods arrive at the same approximate amounts. I have provided numerous opinions on lost profits, both in court and outside of court.
